National Cooperative Grocers Association (“NCGA,” “we,” or “us”) respects your individual privacy and has put this Privacy Policy in place to communicate how we collect, store, and use your information. The policy is effective as of January 1, 2012 and applies to information collected as part of our My Co-op Rocks Video + Photo Contest (the “Contest”) at (the “Site”), and covers the following areas:

  • The personally identifiable information collected by NCGA or by any third party through the Contest;
  • Use of this information;
  • Sharing this information;
  • Choices that are available to you with respect to collection, use, and distribution of the information;
  • Security procedures in place to protect the loss, misuse, or alteration of this information; and
  • Correcting any inaccuracies in the information.

1. Information Collection and Use

As part of the Contest, NCGA may collect and retain information from you, including personally identifiable information such as your name, address and email address, when you register on the site.  We may collect additional information from you if you win a prize as part of the Contest. We do not collect credit card or other financial information, and you should not send us credit card or financial information. We may also collect and retain other personally identifiable information that you voluntarily submit through our Site, and the information that is contained in any video or photo which you submit. Your submission of personal identifiable information as part of the content of your video and photo entries (such as your name and likeness, or the name and likeness of others) grants us permission to display that information to the public.

2. Cookies

We may also collect anonymous data through the use of cookies. A cookie is a small piece of data that is sent to your browser from a web server and stored on your computer’s hard drive. Cookies store information about your use of a particular web site or service and are typically used to make services more convenient and personalized. We may use anonymous cookies called “session cookies” to measure traffic patterns to areas of our Site. Session cookies are created each time you visit one of our Sites, and do not remain on your computer after you leave the Site. We may also use personalized cookies when you have registered with the Site to customize your user experience. Personalized cookies are linked to your personally identifiable information and remain on your computer after you leave our Site.

3. Personal Information of Children Under 13

NCGA complies with the requirements of the Children’s Online Privacy Protection Act (COPPA) and the FTC’s Rule interpreting COPPA (16 CFR § 512). This Site and the Contest are not directed to children and children are not permitted to enter the Contest. We do not knowingly collect any personally identifiable information from children under 13 years of age through this Site.

4. Use of Your Personal Information

NCGA will never give or sell your personally identifiable information to be used for the purposes of sending you unsolicited commercial offers (such as spam) from any third party. We will not ourselves use your personally identifiable information to send you unsolicited commercial offers. Currently, NCGA does not sell, rent, or share customer information to or with any third party not affiliated with or owned by NCGA, except trusted third parties who provide services to us. We may need to contact you for purposes other than marketing. For example, we may need to contact you regarding the status of the NCGA Site, updates to this Privacy Policy, or respond to questions you pose. You may not opt-out of these kinds of communications.

5. Use of Aggregate Information

We may store information that we collect through log files to create a profile of our users. Log files record internet protocol (IP) addresses, browser types, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the Site, track your movement in the aggregate, and gather broad demographic information for aggregate use. Log file data is not linked to personally identifiable information. A profile may be stored detailing how individual customers use the Site. It is used solely for internal purposes, to help us improve the experience of users of the Site. We may share your profile with third parties who assist us in processing the information, analyzing aggregated information, and optimizing our Site.

6. Disclosure of Personal Information As Required By Law

We will disclose personally identifiable information when required by law, or if we have a good-faith belief that such action is necessary to (a) comply with a current judicial proceeding, a court order or legal process served on us, (b) protect and defend our rights, or (c) protect the rights, property, and other interests of our users or others.

7. Business Transitions

In the event NCGA goes through a business transition, such as a merger, acquisition by another company, or sale of a portion of its assets, personally identifiable information of users collected through this Site may be part of the assets transferred. The information transferred or shared remains subject to the promises made in this Privacy Policy, unless you are notified of new terms.

The Site may contain links to other web sites. NCGA is not responsible for the privacy practices or content of these other web sites. We encourage you to be aware when you leave our Site and to read the privacy statements of each and every web site that collects personally identifiable information. This Privacy Policy applies solely to information collected by our Site in connection with the Contest.

9. Security

NCGA takes commercially reasonable precautions to protect any personally identifiable information collected through this Site. However, given the nature of the Internet and the fact that network security measures are not infallible, we cannot guarantee the security of your information. When registering for access to a secure area of the Site, we may ask you to select a username and password. We recommend that you do not divulge your password to anyone. We will never ask you for your password in an unsolicited phone call or in an unsolicited email. Also, remember to sign out of the registered Site and close your browser window when you have finished your work. This is to ensure that others cannot access your personally identifiable information and correspondence when accessing your computer.

10. Correcting, Updating, Deleting and Deactivating Personal Information

If your personally identifiable information changes, you may contact us at the address below to correct, update, or delete and deactivate our record of your personally identifiable information.

11. Notification of Changes

If we decide to change this Privacy Policy, we will post the changes here so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. If, however, we propose to use your personally identifiable information in a manner materially different from that stated at the time of collection, we will notify you by email and by posting a notice on this Site. You are responsible for ensuring we have a current working email address for you in order to receive these updates. If the email address you have given us is incorrect or no longer operable, we will have no further obligation to notify you apart from posting the notice on our Site. Your continued use of the Site or entry into the Contest after modifications have been made indicates that you have read and accepted such modifications.
